GATE LABS PRIVACY POLICY
EFFECTIVE DATE: March 15, 2016PURPOSE OF THIS POLICY
We are committed to the protection of your privacy. We created this Privacy Policy (“Policy”) to give you confidence as you use the Gate Labs hardware, including the locking device installed on your doors, the Gate Labs mobile application, the Gate Labs website, and any related service provided by, or under the control and supervision of Gate Labs (collectively, the “Services”). Any reference to “we”, “our”, and “us” in this Policy refers to Gate Labs, Inc., a Delaware corporation and its subsidiaries and affiliates, which operates the Services. This Policy covers how we collect, use, store, and share your information when you use our Services.
INFORMATION WE COLLECT
Personal Information. When you agree to our Terms and use our Services, you grant us permission to collect the following personal information about you:
Information you voluntarily provide us when you sign up for the Services. This information includes your name, home address, email address, and phone number. This information is necessary for the Services to function for their intended purpose and will be collected through the Services, or outside of the Services in some situations, when you create an account. We will also collect and store communications such as text messages and emails that you send and receive through the Services.
Information you may give us access to as you use the Services. This information includes access to features on your mobile device or tablet, such as your location, address book/contacts, and your photos, videos, camera, and microphone. This information expands the functionality of the Services and will only be collected by us with your permission. Additionally, as part of the functionality of the Services, we will record and process audio and video recordings. We will access and use the recordings for the limited purposes of providing the Services to you, improving the Services, and developing new products and services.
Information we collect automatically as you use the Services. In addition to the information you voluntarily provide us, we will automatically collect certain information as you use the Services for the purpose of enhancing the functionality of the Services. This may include the Internet Protocol (“IP”) address assigned to your computer or device, your geo-location, and the unique device identifier number of the device from which you access our Services.
We will use the personal information we collect about you to provide you with the functionality of our Services, to improve our Services, and to provide you with information about our Services. You can modify portions of this information through the Services by editing the profile associated with your account.
Other Anonymous Data. When you use and visit our Services, we may also use third-party analytics services, which may use cookies to collect generic, anonymous information that does not identify you. We use this information to improve your user experience while using the Services.
Do Not Track Signals. We do not track you or collect your information across third party websites or online services. Thus, we do not receive Do-Not-Track signals, or other similar signals. To the extent that we do receive any such signals, we will not comply with them as it is not an aspect of the functionality of our Services.
Third Parties Using the Services. The Services provide you with the ability to allow third parties to remotely access your home and other buildings through the Services. To provide this functionality, we share your personal information with the third party services that use the Services to access your home and other buildings.
Third Party Payments. When you make a payment via our Services, we do not collect the financial information you provide. Rather, the information is sent to a third party payment platform. We cannot, and do not, assume responsibility for the privacy practices of this third party platform.
Sale of Company or Assets. In the event that we sell all or portions of our company or its assets, including the user information collected through our Services, we will notify you before transferring your information to the acquiring company.
Other than as described above, we do not share your information with any third parties without your consent, unless we have a good-faith belief that such action is necessary to (1) comply with the law (see “GOVERNMENT REQUESTS” section below), (2) protect and defend our rights or property, or (3) prevent an emergency involving danger of death or serious physical injury to any person.
STORAGE, RETENTION, & SECURITY
We use Amazon Web Services to store your information. Additionally, we use a variety of security measures to secure your information, including the following technical safeguards: SSL transport layers, encrypted per-user authentication, and selective PII one-way encryption. Additionally, we use administrative safeguards such as: limiting internal access to personal information based on a need-to-know basis, requiring all employees to sign confidentiality agreements that extend to your personal information, and reviewing the privacy practices of new products and services that we integrate into our Services.
These measures are intended to prevent the loss, misuse, and alteration of the information that we obtain from you. Such loss, misuse, and alteration may occur despite our best efforts to protect your information. We are not responsible to our users or to any third party due to any such loss, misuse, or alteration.
We retain your information as long as you maintain a user account with us, or as long as necessary to comply with the law. If you want us to delete your information and data from our system, please send an email to contact@gatelabs.co.
THIRD PARTY SERVICES BEYOND OUR CONTROL
As described above in the section titled “INFORMATION WE SHARE,” the Services provide you with the ability to allow third parties to remotely access your home and other buildings through the Services. Additionally, payment processing is completed through a third party service, and we store your information on Amazon Web Services. Those third party services are beyond our control. Although we make efforts to select vendors that will respect and protect your privacy, we have no control over any third parties. Thus, we make no guarantees about, and assume no responsibility for, the information or services provided by third parties. We encourage you to visit any third parties to familiarize yourself with their privacy practices.
CHANGES TO THIS POLICY
As we improve or change our Services, we may add to, change, update, or modify this Policy with or without notice to you. If you continue to use the Services, you consent to the new Policy. We will always have the latest version of this Policy available through the Services.
