LIMITED WARRANTY & SATISFACTION RETURN POLICY

THIS LIMITED WARRANTY CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND RESPONSIBILITIES, INCLUDING LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU. THIS WARRANTY IS SUBJECT TO CHANGE WITH OR WITHOUT NOTICE TO THE EXTENT PERMITTED BY LAW.

1. LIMITED WARRANTY

Gate Labs Inc., a Delaware Corporation (“Gate Labs”, “we”, or “our”) warrants to the owner of the Gate Labs hardware (“Customer”, “you”, or “your”) that any hardware provided by Gate Labs to Customer (the “Hardware”) will be free from defects in material and workmanship under ordinary consumer use for a period of one (1) year from the date of original retail purchase (the “Warranty Period”).

The limited warranty described in this document (the “Warranty”) does not extend to any damage or failure which results from (1) acts of God, forces beyond our reasonable control such as power outages, wars, riots, terrorism, labor disputes, earthquakes, alteration, accident, rain, flood, tornado, fire, or other events of “force majeure,” theft, misuse, abuse, negligence, abnormal use, improper or unauthorized repairs, commercial use or modification of or to any part of the Hardware; (2) improper maintenance by Customer or any third party, including improper electrical conditions for charging the Hardware’s battery; (3) improper use or installation of the Hardware in violation of written instructions provided by Gate Labs (which may be provided at the time of purchase or on its website at http://www.getgate.com/help), use of the Hardware for purposes other than for which the Hardware was designed or intended, or use in improper temperature, humidity or other environmental conditions; (4) issues related to any third party product, service, or system; or (5) normal wear and tear or aging. This Warranty is not transferable from the original Customer to subsequent owners and only applies to Customers who purchased the Hardware from Gate Labs or one of its authorized sellers.

The Warranty is limited to the repair or replacement of defective Hardware as described in this Warranty and not to any services provided by Gate Labs. The Hardware is not a certified door lock under standards such as ANSI or BHMA and this Warranty only covers Hardware that is correctly installed in a door in good condition that is properly aligned to the door frame, as described in instructions provided by Gate Labs. You assume all risk associated with the suitability, installation and performance of any third party components, hardware, software and services that you select.

In the event that Customer believes that there is a defect in the Hardware covered by this Warranty, Customer shall follow the instructions available here: www.getgate.com/help. If Customer follows such instructions for returning the Hardware, and Gate Labs determines, in our sole discretion, that the alleged defect is covered by this Warranty, then we will, in our sole discretion either: (1) repair the Hardware using either new or refurbished parts; (2) replace the Hardware with new or refurbished Hardware that is substantially similar to the Hardware to be replaced, or (3) refund to you all or part of the purchase price of the Hardware. This is your sole and exclusive remedy for breach of this Warranty. All replaced parts and Hardware for which a refund is given shall become our property.

You agree to reimburse Gate Labs for the costs related to inspection, testing, repair, shipping and handling of returned Hardware that is determined by Gate Labs, in its sole reasonable discretion, to not be covered by this Warranty.

Any Hardware that has either been repaired or replaced under this Warranty will be covered by the terms of this Warranty for a period of one (1) year from the date of shipment of the Hardware.

Gate Labs reserves the right to change the method by which it may provide warranty service to you, and the Hardware’s eligibility to receive a particular method of service.

2. DISCLAIMER

EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH HEREIN, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GATE LABS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND AGAINST HIDDEN OR LATENT DEFECTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GATE LABS ALSO LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY.

EXCEPT AS EXPRESSLY SET FORTH HEREIN, ALL ASPECTS OF THE HARDWARE ARE PROVIDED TO CUSTOMER BY GATE LABS “AS IS.”

3. LIMITATION OF DAMAGES.

IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER GATE LABS NOR ITS SUPPLIERS SHALL BE RESPONSIBLE OR LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THIS WARRANTY OR TERMS OR CONDITIONS RELATED THERETO UNDER ANY BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY (A) FOR LOSS OR INACCURACY OF DATA OR COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES
 OR TECHNOLOGY, OR (B) FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO BUSINESS INTERRUPTION, LOSS OF REVENUES AND LOSS OF PROFITS. THE FOREGOING SHALL APPLY EVEN IF GATE LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATE LAB’S AGGREGATE CUMULATIVE LIABILITY HEREUNDER SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE HARDWARE THAT CAUSED SUCH DAMAGE. CERTAIN STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE EXCLUSIONS SET FORTH ABOVE MAY NOT APPLY TO YOU.

4. SATISFACTION RETURN POLICY.

If you are the original Customer who purchased the Hardware from Gate Labs and you are not satisfied with the Hardware for any reason, you may return it in its original condition within thirty (30) days of the original purchase and receive a full refund. This Satisfaction Return Policy applies solely if your return package is postmarked within thirty (30) days of the original purchase and solely if you comply with the instructions available at the following URL: https://support.getgate.com.
